Terms & Conditions
The following terms and conditions govern all work performed by Web V8 for your business or personal projects, including both contractual and non-contractual engagements. Web V8 reserves the right to amend these terms and conditions at any time without prior notice. While we currently do not outsource work, we reserve the right to delegate tasks to contractors as needed. For further information, please refer to our Privacy Policy or contact us directly.
1. Deposits & Fees
All payments made to Web V8, including service charges, subscription fees, and product orders, are strictly non-refundable. Deposits are only refundable if Web V8 fails to fulfill its contractual obligations. Changes of mind or alterations in consumer circumstances will not be considered for refunds.
2. Supply of Content & Materials
The client is responsible for providing all necessary content and materials required to fulfill the requested service. This includes, but is not limited to:
- Written copy
- Business information
- Printed materials
- Logos and graphics
- Video content
- Product images
- Login credentials
- Domain and hosting access
Delays in supplying these materials will result in an extension of your project deadline. Web V8 reserves the right to modify our agreement if the required materials are not supplied in a timely manner. If the client fails to provide the necessary materials within three months of the initial request, the order may be terminated.
Designs are developed on a milestone approval basis, with a limit of three revisions. Additional revisions can be requested at an extra cost.
3. Client Liability
The client is solely responsible for all content and media uploaded to their website and servers, including web, mail, and DNS servers. If the website malfunctions within 30 days of completion due to client tampering or unauthorized edits, it will not be covered under warranty. Uploading malicious content to the website or servers will result in client liability, and corrective actions, including cancellations and potential legal action, may be taken.
4. Cooperation & Engagement
Access to previous domain and hosting service credentials may be required to process transfers or set up services. If your previous service provider retains access to your backend or hosting services, Web V8 absolves itself of any responsibility for issues arising from their involvement. Due to enhanced authentication technologies (e.g., two-factor authentication), your cooperation may be necessary to fulfill an order. Failure to cooperate during this process may result in the inability to complete your order.
5. Rejection of Work
If you decide to cancel or reject the service prior to completion, or do not approve milestones beyond the three revisions provided, despite the work being satisfactory and within the requested scope, Web V8 reserves the right to terminate the contract and seek payment for the completed work.
6. Website Rankings
Web V8 does not guarantee specific positions in search engine results, as these are controlled by third-party providers with frequently updated algorithms. However, we adhere to best practices in search engine optimisation and implement updates using appropriate tools.
7. Limitation of Liability
To the fullest extent permitted by law, Web V8 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use our services
- Any unauthorised access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from our services.
8. Indemnification
You agree to defend, indemnify, and hold harmless Web V8, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
- Your use of and access to our services;
- Your violation of any term of these Terms & Conditions;
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
9. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
